Terms of Service & Permissible Use Policy

Effective September 9, 2026

Plain-language summary: SkipTraceToday helps you clean property-owner lists and look up current contact information. You are responsible for having a lawful reason to run each lookup and for how you use what it returns. We are not a consumer reporting agency, and this tool is not a substitute for one — see Section 4 and the Permissible Use Policy below before you use results for anything beyond real estate marketing and outreach.

Terms of Service

1. Who you're contracting with

SkipTraceToday ("SkipTraceToday," "we," "us," or the "Operator") is operated by Charles Collantes, an individual based in the Philippines. SkipTraceToday is not currently operated through a separate incorporated legal entity. These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or the "Customer") and the Operator governing your access to and use of the SkipTraceToday website, application, and related services (collectively, the "Service").

By creating an account, accepting these Terms at signup, or using the Service, you agree to be bound by them. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization as well as you individually.

2. The Service

SkipTraceToday lets you import lists of property records, cleans and deduplicates them at no charge, and — only once you confirm a trace — runs a skip trace against those records to return current owner contact information (such as name, phone, and email) sourced through our data provider(s). Cleaning is free; you are only charged credits for records you affirmatively confirm for tracing, and only when a match is returned.

3. Accounts, organizations, and credits

  • You must sign in with a real Google account tied to a real individual; shared or fraudulent accounts may be suspended.
  • An organization's Owner can invite members, adjust member-level spending caps, and is solely responsible for that organization's compliance with these Terms across all its members.
  • Credits are purchased individually (pay-as-you-go) or included with a monthly subscription plan. Credits do not expire. Credits are consumed only when a lookup returns a match — a lookup that returns no match does not consume a credit.
  • Fees are billed in advance (subscriptions) or at time of purchase (top-ups) via PayPal. Except where required by law, fees and consumed credits are non-refundable. Unused subscription credits do not carry a cash-refund value if you cancel.
  • We may change pricing prospectively with notice; changes do not apply to credits you have already purchased.

4. Not a consumer reporting agency

SkipTraceToday is not a "consumer reporting agency" as defined by the U.S. Fair Credit Reporting Act (FCRA), and the information the Service returns is not a "consumer report" under the FCRA. We do not compile, assemble, or furnish information for the purpose of establishing a consumer's eligibility for credit, insurance, employment, housing/tenancy, or any other purpose covered by 15 U.S.C. § 1681a(f)-(d). You may not use the Service, or any information obtained through it, for any FCRA-covered purpose. See the Permissible Use Policy below for the full list of prohibited uses.

5. Data accuracy and no warranty on results

Contact information returned by the Service is sourced from third-party data providers and public/commercially available records. We do not independently verify the current accuracy of any name, phone number, or email address returned, and we make no guarantee that any given lookup will find a match, or that a match is current, complete, or correct. You are responsible for independently verifying information before relying on it for any consequential decision.

6. Your responsibilities and representations

Each time you run a lookup, you represent and warrant that:

  • You have a lawful, permissible purpose for obtaining the information, as described in the Permissible Use Policy below;
  • Your use complies with the FCRA, the Telephone Consumer Protection Act (TCPA), applicable CAN-SPAM and state telemarketing/do-not-call laws, applicable state data broker and privacy laws, and all other laws that apply to you and your use case; and
  • You will not use the Service to stalk, harass, defraud, or locate an individual for any unlawful purpose.

Compliance with the laws that apply to how you use the data — including any state-specific licensing, registration, or disclosure obligations that apply to your own business — is your responsibility, not ours. We provide the lookup tool; you supply the permissible purpose and remain responsible for what you do with the result.

7. Acceptable use

You agree not to:

  • Use the Service for any purpose prohibited by the Permissible Use Policy;
  • Attempt to circumvent credit charges, rate limits, or access controls;
  • Resell, sublicense, or bulk-republish raw lookup results as a standalone data product;
  • Reverse engineer, scrape, or use automated means to access the Service outside the provided import/export tools; or
  • Upload lists you do not have a lawful basis to process.

8. Intellectual property

We own the Service, its software, and its design. You own the lists you upload and the results you export. You grant us a limited license to process your uploaded data solely to provide the Service to you.

9. Termination

You may stop using the Service and request organization deletion at any time from Settings, which is honored on a 30-day delay so it can be cancelled if requested in error. We may suspend or terminate your access if you violate these Terms, misuse the Service, or fail to pay amounts owed. On termination, your right to use the Service ends immediately; Sections 4–6, 10–13, and any accrued payment obligations survive termination.

10. Disclaimer of warranties

THE SERVICE AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. THE OPERATOR'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

12. Indemnification

You agree to indemnify and hold the Operator harmless from any claim, liability, damage, or expense (including reasonable attorneys' fees) arising from: (a) your use of the Service or any information obtained through it, (b) your breach of these Terms or the Permissible Use Policy, or (c) your violation of any law, including the FCRA, TCPA, or any state data-privacy or data-broker law, in connection with your use of the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to conflict-of-laws principles, regardless of your location. Any dispute arising from these Terms or the Service will be resolved by binding individual arbitration under the American Arbitration Association's rules, except that either party may bring an individual claim in small-claims court. You and the Operator each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by emailing the address below within 30 days of first accepting these Terms.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will require re-acceptance on your next login (tracked by version date). Continued use after a non-material update constitutes acceptance.

Permissible Use Policy

Skip-traced contact information is sensitive. Before every lookup, you must confirm you have one of the following lawful bases for obtaining it. This list is illustrative, not exhaustive — if you are unsure whether your use case qualifies, do not run the lookup until you are sure, or consult your own counsel.

Permitted purposes

  • Contacting a property owner (including absentee or LLC-held owners) about a potential real estate transaction;
  • Debt collection on an obligation the subject actually owes;
  • Locating a party to litigation, or serving legal process;
  • Other uses that do not require FCRA, GLBA, or DPPA-covered eligibility determinations, and that comply with applicable telemarketing/TCPA and CAN-SPAM rules for any resulting outreach.

Prohibited purposes

The Service may not be used to obtain information for:

  • Employment eligibility, hiring, or tenant-screening decisions;
  • Credit, insurance underwriting, or any other FCRA-covered eligibility decision;
  • Stalking, harassing, intimidating, or physically locating a person against their wishes;
  • Determining a person's eligibility for government benefits; or
  • Any purpose prohibited by the Driver's Privacy Protection Act, Gramm-Leach-Bliley Act, or comparable state privacy statute.

Every lookup you run is logged against your account, the organization that ran it, and the policy version in effect at the time — this is your audit trail if a subject or regulator ever disputes a lookup. Misuse may result in immediate account termination and, where applicable, a report to the appropriate authorities.

Not legal advice. This document is a good-faith starting point drafted to reflect how the Service actually works, not a substitute for review by a licensed attorney — particularly given SkipTraceToday serves U.S. customers with FCRA-adjacent data while operated from outside the U.S. If your usage grows, especially into any state that requires data-broker registration (e.g. California, Vermont, Oregon, Texas), get this reviewed by counsel familiar with U.S. consumer-data law.
